Family: Finance

The Family Finance team is a well-established and highly committed team of practitioners with a wealth of experience in matrimonial finance and trusts of land.

From our most senior members through to our junior members, our expert barristers represent parties at all stages of litigation: from advice and settlement negotiations, to preliminary issues, interim applications for maintenance pending suit, section 37 injunctions, mediation, arbitration and contested final hearings. With this wide range of experience and expertise, we are able to match our professional clients to the most suitable barrister and we regularly appear in the Family Court including at High Court and Court of Appeal level.

Our specialist matrimonial finance barristers are regularly instructed in the full range of cases, from those involving pension sharing, high net worth individuals, to claims of a lesser value, which can often be the most challenging to divide. Members of our team have developed expertise in advising clients on issues such as:

  • High profile or ‘big money’ financial relief
  • Complex trusts/business or company structures
  • Concealment/dissipation of assets
  • Partnerships
  • Inherited wealth farms
  • Pension sharing/shareholding/pension rights

  • Foreign divorces brought pursuant to the MFPA 1984
  • ‘Forum shopping’ and contested international jurisdiction

We also have many specialist finance Counsel who regularly deal with cases involving: contested divorces, inheritance act claims, civil partnership breakdowns, trust of land disputes between cohabiting parties, pursuant to TOLATA 1996 and also cases involving financial provision for children, pursuant to Schedule 1 to the Children Act 1989.

Our Team recognise that family proceedings can be difficult both financially and emotionally. The team are committed to working together, with lay and professional clients, to achieve the best possible result. We are mindful of the costs of litigation, both in financial and emotional terms therefore we seek, where appropriate, to avoid lengthy and unnecessary litigation. With this in mind, we accept and encourage instruction at an early stage of litigation.

We provide clear, tactical and pragmatic advice, dealing with cases sensitively and tactfully whilst working alongside both solicitor and lay clients. We have a friendly, sympathetic, yet robust approach, always providing practical and responsive advice.
