Hague Convention

These applications demand a prompt action as the outcome could be dramatic with the possibility of immediate return overseas. A response at the earliest time is therefore required either in order to secure the correct protective and investigative orders or where the parent has fled, whether any defences for return are available.

Non-Convention Countries

If the proceedings involve a child that has come from a non-convention country, the best interests of the child is the court’s primary concern and any issue in relation to the custody of the child is decided in the country of habitual residence.  

These applications are usually made on an emergency basis. Our team are ready to advise either by phone or conference and are ready, where necessary to make without notice applications at very short notice.
